BOOKING TERMS FOR SNORKEL AND DIVING TOURS
By confirming a snorkel or diving reservation with La Paz Explorer (payment of a 20% deposit or full amount and receipt of a reservation, booking, or invoice number), you confirm that you have read and accepted our Booking Terms and Cancellation Policies. This agreement is between the participant(s) and La Paz Explorer (commercial name of La Paz Explorer Diving and Services SAS de CV).
- A 20% deposit or full payment is required to confirm any booking.
- The remaining balance must be paid at least 24 hours before the scheduled activity or first day of a multi-day booking.
- Tours where we pick up participants from charters or private boats must be fully paid before the charter or private vessel departs.
- Late arrivals may be considered no-shows and may result in loss of the activity without refund.
- All participants must submit required information in advance and sign a liability waiver on the day of their tour prior to participation.
- Marine wildlife encounters are inherently unpredictable. Sea lions, whale sharks, and other species may not be visible, swim nearby, or interact with participants, and sightings are not guaranteed under any circumstances.
- Environmental conditions (visibility, water temperature, currents, sea state) may vary.
CANCELLATION POLICY FOR SNORKEL AND DIVING TOURS
- Cancellations made more than 7 days before the activity are eligible for a full refund minus card and processing fees (5%).
- Cancellations made within 7 days and more than 24 hours before the tour start time result in the loss of the 20% deposit of the total reservation amount.
- Cancellations made within 24 hours before the activity, as well as late arrivals and no-shows, including cases of illness, accidents, travel delays, personal emergencies, or any other circumstances beyond the participant’s control, are fully non-refundable. All payments made, including the full balance if already completed, will be retained. Failure to meet at the designated time and location is considered a no-show.
- On shared tours, the confirmed booking is binding for the full number of participants reserved. Cancellations apply per participant, and payments are non-transferable between participants. Each activity requires a minimum operational number of participants, which varies depending on the activity and vessel type. If fewer participants show up than originally confirmed in the booking and the minimum operational requirement is not met, the operator reserves the right to cancel the activity. In such cases, no refunds, credits, or transfers will apply.
- Private Tours: Changes to group size are subject to availability and must be communicated at least 7 days before the activity. Changes made after this deadline are subject to the standard cancellation policy.
- Operator-Initiated Cancellations: In the event that the activity must be canceled due to unforeseen circumstances such as adverse weather conditions, harbor closures, or vessel damage/mechanical failure, the full amount paid will be refunded or issued as credit. Credits, when issued, are valid for 1 year from the original activity date and are subject to availability.
CANCELLATION POLICY FOR MULTI-DAY BOOKING – FOR SNORKEL AND DIVING TOURS
- Cancellations made more than 15 days before the activity are eligible for a full refund minus card and processing fees (5%).
- Cancellations made within 15 days and more than 24 hours before the tour start time result in the loss of the 20% deposit of the total reservation amount.
- Cancellations made within 24 hours before the activity, as well as late arrivals and no-shows, including cases of illness, accidents, travel delays, personal emergencies, or any other circumstances beyond the participant’s control, are fully non-refundable. All payments made, including the full balance if already completed, will be retained. Failure to meet at the designated time and location is considered a no-show.
CANCELLATION POLICY FOR AGENCY BOOKINGS:
- Cancellations made more than 30 days before the activity or the first scheduled activity day are eligible for a 50% refund of the 20 % deposit, minus card and processing fees (5%).
- Cancellations made within 30 days and more than 24 hours before the activity or first scheduled activity day result in loss of the 20% deposit.
- Cancellations made within 24 hours before the activity, as well as late arrivals and no-shows, including cases of illness, accidents, travel delays, personal emergencies, or any other circumstances beyond the participant’s control, are fully non-refundable. All payments made, including the full balance if already completed, will be retained. Failure to meet at the designated time and location is considered a no-show.
TERMS AND CONDITIONS FOR SNORKEL AND DIVING TOURS

1. GENERAL REQUIREMENTS
- All activities are subject to availability and weather conditions.
- All participants must complete and sign a liability waiver before the start of any activity.
- All ages are welcome on Snorkeling Trips (with adult supervision).
- To participate in Scuba Diving, participants must be in good health and free of medical conditions that are incompatible with diving. A valid medical certificate may be required.
- Minimum age for Scuba diving: 10 years old (with parental consent and adult supervision if under 18).
- If the following information is not provided at least 24 hours prior to the start of the activity, we cannot guarantee that we will be able to provide properly fitting equipment or ensure that lunch (when required) meets dietary needs or restrictions:
- Height and Weight: For appropriate wetsuit and/or BCD (buoyancy control device) sizing.
- Shoe Size: For proper fitting of fins.
- Food Allergies: To prepare suitable lunch options (only available for day trips departing from La Paz).
2. UNUSED TANKS, UNFINISHED DIVES, INCOMPLETE SNORKEL ACTIVITIES AND PHYSICAL DISCOMFORT
- No partial or full refund will be provided for unused scuba tanks, unfinished dives, or incomplete snorkel activities not completed by the participant, due to personal choice or the guide, dive master or instructor’s. This includes:
- Voluntary decision not to dive or snorkel.
- Discomfort with ocean conditions (if deemed safe by guide, dive master or instructor).
- Sudden lack of confidence or preparedness not caused by a serious medical issue.
- Seasickness, nausea, panic, or any other physical discomfort that leads to the decision not to continue the dive or snorkel activity.
- No partial or full refund will be provided in the event of abandonment of a dive or snorkel activity for any reason. The activity will be considered incomplete, and no reimbursement will be provided for the unused portion. This includes situations where a participant, whether from the same booking or not, experiences panic, illness, or any issue that impacts the group’s dive or snorkel activity, leading to its abandonment. The guide, dive master or instructor has the authority to stop or abandon the dive or snorkel activity for the safety of any individual or the group as a whole.
- The safety and well-being of the participants are of the utmost priority, and while we strive to ensure a safe and enjoyable experience, it is the participant’s responsibility to communicate any discomfort or concerns immediately.
- Dives or snorkel activities canceled for medical reasons may be rescheduled if valid medical documentation is presented.
- La Paz Explorer reserves the right to refuse participation if a guest is deemed physically or mentally unfit to dive or snorkel safely.
- All tours involve wildlife in their natural environment. Sightings cannot be guaranteed. No refunds will be issued in the event that animals are not sighted or do not approach.
3. DIVE COURSES
- Our dive courses are certified by PADI or SSI and taught by qualified instructors.
- Certification is subject to the successful completion of both theoretical and practical requirements.
- Failure to comply with safety protocols, uncooperative behavior, or lack of commitment may result in expulsion from the course without a refund.
4. EQUIPMENT AND FACILITIES
- All equipment provided by La Paz Explorer must be used responsibly.
- Any loss or damage due to misuse will be the participant’s responsibility and must be covered financially.
- Participants may bring their own equipment if it is in good condition and meets safety standards.
5. INTERACTION WITH MARINE LIFE
- We are committed to responsible and respectful interaction with marine environments. The feeding or harassment of marine animals, as well as the engagement in unsafe or inappropriate diving or snorkeling practices, is strictly prohibited. Violation of this rule may result in early termination of the activity without refund.
6. PHOTO & VIDEO POLICY
- During activities, we may take photos and videos for promotional purposes.
- By participating, you grant us permission to use your image on social media, our website, and marketing materials, unless you request otherwise in writing before the activity starts.
7. TRANSPORTATION
- La Paz Explorer does not include land transportation in any of its activities.
- It is the participant’s responsibility to arrive on time at the designated meeting point.
- Refunds or rescheduling will not be offered for delays or absences.
8. TIPPING POLICY
- Tips are not included in the activity price.
- While not mandatory, tips are appreciated by our guides, dive masters and instructors if you feel the service was professional, safe, and friendly.
9. SPOKEN LANGUAGES
- Our staff speaks primarily Spanish and English.
- If another language is required, please notify us during booking. Availability of additional languages cannot be guaranteed.
10. SAFETY AND LIABILITY
- La Paz Explorer adheres to the highest safety standards. However, scuba diving and snorkeling involve inherent risks. By participating, you acknowledge and accept these risks and release La Paz Explorer, its instructors, and staff from any liability for injuries, damages, or personal losses.
- We recommend having valid travel insurance and/or dive-specific insurance.
11. DATA PROTECTION
- Your personal data will be handled in accordance with the Mexican Federal Law on the Protection of Personal Data.
- Data will only be used for purposes directly related to the booked service and will not be shared without your consent.
11. GOVERNING LAW AND JURISDICTION
- These Terms and Conditions are governed by the laws of the State of Baja California Sur, Mexico.
- Any disputes will be resolved by the competent courts in La Paz, B.C.S.
